These people called me, threatened me, told me they would make sure I was served court papers at work so that I would be fired, but this could be prevented if I would settle the debt (which is not valid)and they'll let me settle out of court for $394.00 *** Dont really understand this since I never took out a pay day loan from this company, nor did I ever receive any type of correspondence or phone calls regarding this until 6/7/2010 (its from 2004). I told them if they could offer some proof that the debt is valid I'd be happy to pay it, they say its not our responsibility to offer proof. Im following the advice of the person that said contact the attorney general.

I suspect it is a collection agency, however Ms Berrick identified herself as Investigator Berrick, and made it sound as if she was part of Bernalillo N.M County Police Department. She would only say that she is located in Georgia and used scare and threatening (meaning Legal Action would be taken, and used the term civil complaint several times)/ She was agressive and rude. I advised her to remove my name from her call list.

So I called to complain to the government and yell.

Same exact thing happened as to all of you!! So glad i found this, because they are very intimidating!! Very important to report to the FTC 8009525210 and also the Dept of Justice atty general 800-952-5225.
FTC confirmed THIS IS A SCAM, by law, any agency HAS to furnish you with proof to support their claim. I called back stating that the call was being recorded, and I had a member from the FTC on the phone with me, and "Victor" stated he "did not give his permission to be recorded but ok" and I told him it is against the law to bully someone into a settlement without furnishing proof of the debt, and illegal to refuse to furnish proof and instead making them wait for court, and asked him what he plans to do, i have a fax for him to send the information to, and he rudely said they are going to move forward as planned and then hung up. I then called back again, asked the lady who answers the phone what his last name is, she said and spelled "Black", and i said I need you to relay a message to him, she said hold on, put me on hold for a minute, came back, asked what the message was, and I told her I was instructed by the FTC to file a report against him and your organization with the Dept of Justice Atty General, and she quickly cut me off and said "i will give him the message" and hung up. Called my 90 year old grandmother and threatened to take action in my county, and to get my lawyer ready...which of course concerned her and she called me. He referred to my divorced last name (from many years ago). Gave the call back number 877-201-3399 and another number that sounded like a phone number but was one number short. She called and relayed the message to me, but I do not have any outstanding debt (exception medical bills). I believe this is a scam, and will pursue legal action if they contact my 90 year old grandmother again.

I received a voice mail on my cell phone from "Investigator"... someone. He rudely informed me that a "relative" was going to be arrested in 48 hours if they didn't return the phone call.

First of all, when they called me, they called me by my ex-husband's last name. When I got married, I NEVER changed my name. That's always a big clue that something isn't right.

Second, it's a civil matter - you're not going to be arrested.

Finally, they run and hide when you say you are recording the phone call.

My advise... FIGHT BACK! THIS IS A SCAM!

Here's how:

1. Call them back but DO NOT give them any information!
2. Say you wish to record the conversation for legal purposes (they should hang up quickly). If not, read on...
3. Tell them the truth! Say you know this is a bill collector and you're going to take legal action against them (even if you're not).
4. Laugh at them, they HATE it!! They were screaming at me and I just kept laughing - drove them crazy!!
5. Talk like a fool! When they ask for your SSN say that you were born on Mars and raised by apes, therefore you have no SSN.

You get the idea.

Anyhow, the bottom line is that this is merely an attempt to collect a debt.
We all know the best way to avoid bill collectors is by paying our bills. However, sometimes it's not possible. Sometimes (like myself), they are calling relatives... even children. Stop them, you have the power.
Just remember, never give personal information over the phone.

A "Special Investigator" named Steven Pratcher (sp?) left a frightening voice message at my home stating that a "civil complaint" had been filed against me in Los Angeles, and that if I or my legal rep did not call within the next 48 hours a "warrant" could be issued for my arrest, at my home or place of business.

Because I had seen a similar scenario featured on the local news, I decided to Google the telephone number. I'm glad I did! I was surprised to see so many people with the same scenario, the same number, and even the same "investgator." I haven't yet returned this guy's call(s) and, after reading the numerous entries made by others who have, I don't plan to.

This man's "routine" is quite frightening, and even had me nervous, for a few minutes. I can only imagine how intimidated an elder person might feel, and how easily they might feel compelled to send money.

I just submitted the information to the FTC prior to submitting this. Thank you for hosting this site. If not for your site, I would have called this guy back and probably would have peed myself, by now!

My neighbor next door got a message on their answering machine that was intended for me. How frustrating is that?! In the message... an Investigator Lynn Berrett said I have a civil law suit against me. All this on my neighbors machine... how embarrassing!!! I called the number later that day 877.201.3399 and they said it was regarding a past due cell phone bill from 1999... REALLY?!!! When I asked for a copy of my last bill statement, they said the only way I could do that is if I take this matter to court with their clients (cell phone company). I was transferred to a man named Tim Detoh... that told me I could settle this outside of court by paying the balance now. I told him I wanted to call back so I can talk to my attorney. He said there is nothing that my attorney can do to change the matter... My choices are to either settle this in court or outside of court. Here's my question?... how is a past due phone bill with a very well known mobile company a civil suite? Thankfully I googled the number online and found all of your complaints! Glad I found this site. Caller Deputy Davenport claimed to be with Sheriff's Dept. stating there was a gentleman there filing a civil complaint against me. Spoke with unnamed male who is trying to collect on a loan with Check N Go, unpaid balance of $1580. Relayed this was not our debt, they had the wrong person or it was an identity theft situation. This "gentleman" stated that 4 payments were made and it was highly unlikely a thief would make 4 payments and run. He said the balance on this loan, which originated June 17, 2003, is $1580. Told him it was not our debt and he stated he would send the sheriff to my door with a summons if we didn't pay. I told him to go ahead, it's not our debt and we'll fight it in court. This site has all the numbers for the FTC, etc, I'm using them to file complaints.

When I called them back, I was transferred repeatedly, told that this was not an attempt to collect a debt but that they could offer me a settlement. Not once would anyone I spoke with give me a name and no one would give me a physical address. Please file a complaint with the FTC 877-382-4357 and with the governor's office of consumer affairs in Georgia, 800-869-1123. Person called my parents house claiming to be investigator, told them they were listed as emergency contact and provided case number. All of this is a complete falsehood. When contacted, they tried to solicit personal info, like SSN, etc...and gave no details as to why. Individuals were extremely rude...surpassed harrassment by a long shot. Told them not to ever call again, and that I was fully prepared to aggressively pursue a complaint. This is cleary a scam of wome sort, trying to fish for personnal info based on some kind of mish mash info they are putting together from some kind of public sources. This gentleman is apparently with Legal Action Recovery a firm (quote) from Georgia trying to collect on an old balance with Discover Card that was paid off in 2003. I paid this for my son at that time and this company is stating that we will be sued for this amount again. The problem is ther rudeness, threats and lack of understanding of proper handling of customers. This may be a reputable company but they smell of scam. When this gentleman was asked he was unable to give any solid information (account numbers etc.) and left me questioning what the blank is going on. I am in the process of contacting the State of Delaware Attorney General over this matter.

A "Special Investigator called and left a voice message at my home stating that a "civil complaint" had been filed against me and if I did not call within the next 48 hours a "warrant" could be issued for my arrest. When I was able to speak to someone by referencing the "case" number they left on the recording, they stated that this was a debt from a visa account opened in 1997. I stated that this was past the statute for my state(California is 7 yrs) so the this debt was uncollectable. The "special investigator" that answered the phone said, "Oh, no it's not. The last payment on this account was made in October of 2007." I told her that I had not idea of the existence of this account and asked for the company that they were representing. She said the original account was with Household Bank but the debt was now owed to Atlantic Financial. I explained that in 1997 I never had an account with Household Band and possibly this might be someone else's debt...maybe I had been a victim of identity fraud. I also said I would like the original account number and the information on the company that I actually owed. I was eventually transferred to the "Director" Tim Detoh who began by using a very intimidating tone with me and saying that regardless if I remembered this debt or not that I was responsible for it and they would be filing court papers if I did not take care of it immediately. That his clients would not be providing any proof of debt paperwork to me until the court date. He then stated that my ss # was attached to this file and that my signature had been verified by my state drivers' license on file. Every time I tried to get any more information from him he would be very aggresive and talk over me. I said that I would like to speak to my attorney about this issue to inquire on the legitimacy of the debt and he got very angry and said, "Fine, we will see you in court!! Have a good day!!" and hung up the phone. When I called back he had sealed my file so that the phone agents could not access it and left a message for me that no one in his office would help get any additional information. At this point, I was still concerned that there might be a shred a truth in this issue, so I called a Bankruptcy Attorney that I know and explained what had happened...they told me that this was illegal and that I have a right to verify the legitimacy of the debt and if they could not produce it then it was probably because the debt was purchased by them for pennies on the dollar for collections. They also gave me additional information on how this could not be collected on in court because that is not how civil small claims cases are handled. I since did mor investigating on their company and found many stories that were similar. They also have another toll free number that they call from. Find out your rights before you give them any money. They are unscrupulous and will be very abusive with you but that is against the law. I have filed a complaint against them with the Federal Trade Commission and I urge any of you with similar stories to do the same...it is not right to threatened people and harrass them about debts that they will not prove are legitimate and collectable. I'm glad I looked up this number! They are so full of ****! There is nothing they can do to me!! I read some of these other complaints and they are all so similar I feel like calling them back and telling them HA! HA! You can't go to jail or be sued for owing a debt on credit cards, so people do not get scared, they are just trying to scare you. Just have a good laugh!!:)

Got a call from an "investigator" from this joke of a company saying I owed 500+ dollars on a credit card account that was closed with a zero balance in 2002. This is obviously a scam which I immediately reported to the Federal Trade Commission. You should do the same if this happens to you. The more complaints they receive, the more likely they will launch an investigation.

called my parents home where I have I have not lived in 30 years to say something about a civil legal matter. The caller said that they needed to hear from me or my lawyer or my representative within 24 hours or they would see me in court. I have no knowledge of any pending litigation or any reason for any. How do they think that anyone in this day and time can see someone in court without a summons or being legally notified.

Called my fathers house today. I have not lived there for over 20 years. Gave a case number and phone #. I googled the number and I saw all of these reports. Decided to call them (curious)and it took her about 3 minutes to tell me what it was she called for. Tried to get some personal info. I told her I was looking at some complaints on the company, she didn't have much response. She kept trying to tell me it was a credit card company that had hired them to collect on a debt, when I told her I had no such credit card from that company, she then continued to make herself sound more stupid by saying that my signatures matched on the credit card application that they matched from "some out of state license". How stupid. I hung up on her.

My mother-in-law and brother-in-law received messages on their voice mail about a pending law suit against me and that I needed to contact Investigator Maxine Billings ASAP at 877/201-3399. Mind you they some how found my in-laws but never called my home or sent me anyting in the mail, I have lived at the same address for numerous years. When I called they told me that I owed some bank $5000 but if I was willing to settle for $3000 then they would stop legal proceedings all I had to do was give them a bank account # or a credit card #. When I asked for proof of this debt they were unable to give me any until I made a payment. Obviously this made me very suspicous. At this time Tim Detoth told me that if I didn't make a payment there was nothing they could do to help me. I said no proof, no payment. I then reported them to the Federal Trade Commission at 877/382-4357, The Better Business Bureau in GA at 866/225-1090 (the company is located in GA), and the Consumer Affairs at 800/952-5210. Don't let these people scam you out of money!

We received a call from this number asking to speak with our daughter who has never lived at this address. The message was "regarding to a complaint which is being filed against you" threatened "failure to address this matter may lead to legal ramifications" "looking forward to speak with you to avoid further action" and left a file number to refer when calling back.

I called back just to see what kind out outfit it was and the 'investigator' said it was about a credit card with FirstUSA that was delinquent and that 'you are going to receive a summon and the courts are not lenient in these matters and if I am interested in settling this case he could transfer me to another departments....."

We know our daughter has a squeaky clean credit history and no pending dispute with anyone. We have saved the voice mail in a file and are going to submit a complaint with our state attorney general's office and also advise our daughter to pull her credit report just to be sure.

Amazing how people can revert to fraud and intimidation to make their living.

Left a message claiming that there was a "Civil complaint" filed at "Her office" and that I, or "legal council" should call back, and that "Failure to address these pending allegations will proceed to court action being filed against you in your court."

After checking here, I called the number and said, simply, without identifying myself with their bogus ID number, that I would be informing the FBI about their activities. The lady answering the phone hung up so fast I think her finger must have broken the sound barrier on it's way to the "hangup" button on her telemarketter gear.

I would assume that these people are "posing" as some sort of collection agency. About three months ago, by parents started receiving calls from RPM (Receivables Performance Management). I immediately googled RPM and found stories, just like these, about how RPM had been harassing them and their families over nothing. I work in an office with an attorney and I have the ability, thank goodness, to pull my credit report at anytime. I noticed that RPM was on there as a collection for a Sprint account that I used to hold. I contacted Sprint and guess what...they had no idea what I was talking about and assured me that they would deal with this by the end of that day. By the way...Sprint's internal collection agency is RJM (ironic).

Sure enough, I pulled my credit four weeks later and the collection from "RPM" was gone. Go figure. Yesterday, my parents received a phone call from Brittany, with Legal Action Recovery, and she stated that she was calling about my "case". Hmmm...I googled Legal Action Recovery and here we are again.

These people are killing me. They can't be serious. I never held a past-due account with Sprint, but they are certainly trying to collect on one. Did they not get the memo from Sprint (the one that forced them to remove themselves from my credit report in the first place)??

Do not fall for this scam. It's a joke, and a really pathetic one at that.

Hi, I've actually been doing a lot of research on this very topic, and basically what these people are doing is looking for victims who don't know their rights and panic to repay an old "zombie" debt. For more information on Zombie Debt in general, please check out http://money.howstuffworks.com/personal-finance/debt-management/zombie-debt.htm If you notice, the names they use and the accounts they refer to are usually very old (9-10 years+), so this makes sense to me. They have recently contacted my home phone looking for my father using the same threats, etc. The more the people know their rights and who are very familiar with the FTC (especially with credit), the better.

My mother (who lives in another state than me) received a voice mail from this "investigator Noel Lucas" she needed to verify my address to serve a summons with a "thank you and good luck" at the end of the voice mail. Well I made the mistake of calling the number back 877-201-3399. Spoke with a "investigator Riddington" I speficllaly asked what police department he worked for with a response from him he does not work for a police department. I then ask if he worked for a collection agency and his response again was “NO”. He stated that he would have me arrested, pursue legal actions against me. I asked what I was being arrested for or having legal action against me for with a response of he does not have that information. WHAT??
He then hung up on me. Well I called back again and got “investigator Noel” rude refused to give me any information and just kept saying “good luck”. I asked again for the details of the pending legal matter or pending arrest was for with no additional information just a “good Luck” and hung up. Before she hung up with me she stated the phone call was being recorded. This was the first I heard of this. She did not state the phone call was being recorded when she picked up the phone. Nor did any of the other “investigators.”
I called back again and spoke with “investigator Presson” again asked if he worked for a police department he stated “no”. I asked if he worked for a collection agency he stated “no”. He stated he worked for a attorney and the attorneys name was “Jeffery Goldsmith” I asked where Mr. Goldsmith office was located and was told his office was located in Minneapolis. I searched the MN state bar for Mr. Goldsmith and he was not listed at a member of the bar.
BUT all of the “investigators” were willing to settle the case with me if I provided them with my bank account information or a credit card.” I asked several times for details about the case and no one had or was willing to give up the information. I advised them I would not settle a “pending” legal case without documentation about the case and again got “good luck.”
I will be filing a complaint with the State of Georgia consumer affairs, the FTC the BBB.

Same story as the others. They called my home, my parents, and her parents home looking for my sister in law, but they used her maden name which she hasn't used in many years. The message said that someone was filing a medical claim against her and that if she didn't call back within 24 hours then a warrent would be issued. It sounded fishy to me right away and I told her to be careful if she called back. I'm glad that I googled the phone number and saw these stories. I got right back to her and told her not to call. With the exception of the "story line" change the same things were said that were said to the others. Our names were listed as emergency contacts, warrent threat and had a case number. DON'T CALL THEM BACK!!!

Received a call at my office saying that a sheriff would be coming to my office to serve me with a summons for non-response to a civil complaint. She ended the call - I'm sorry for your situation and wish you good luck. Then gave her number again.
When I called to ask who the agency was the fellow who answered the phone refused to say until I told him that I was filing a complaint with the FTC since his company was in violation of the FDCPA (fair debt collection practices act) and that I had saved the recording of the threatening telephone message. He then gave me this information - the company is Legal Action, 1640 Powers Ferry Road, Marietta, GA.
Oh, he also told me to stop calling him at work that he did not want to be bothered by me again.

Just to let everyone know...
There are certain rules, called The Rules of Civil Procedure, that must be followed in any legal action. If someone files a lawsuit against you, they MUST notify you through a court-approved process server, and you are given every opportunity to defend yourself. If they are unable to find you, or serve you with a court summons, then the lawsuit can NOT go forward. This is federal and state law.

I am saying this because there is no such legal situation that could possibly exist that these sleeze-bags are threatening anyone about. It is all scare tactics. Don't ever return such a phone call. If there is a real lawsuit against you, you will get a summons from a process service. It is NEVER, EVER appropriate or legal to notify someone by phone. If you get such a phone call, you should immediately notify your state Attorney General and the phone company.

This person ask for my son and also has my unlisted phone number as will as my other son's number. Leaving a message the a civil case has be filed against him and gave a case number. I looked up the case number and the case had nothing to do with him but of someone he had worked with for only a week in Leary County. I called them back and a Lt. Maxine Dillinger she said her name was for I had ask who my son ask for when I gave him for the information. She said the filed complaint was from Leary Co. and if my son didn't call the were having their sheriff come out to our address and give him a summons to him to appear in court. She said that they could take care of matter here if he call before they sent out the sheriff. I said is this in Colorado she said she didn't know but the Leary Co. court called and had the information on him and if he acted soon he wouldn't have to go back to the county where is was filed. My son called and they said it was to get him to call and that he owned $3000 to Chase bank credit card and if he paid now they would take a $1000 off and could pay only $2000 instead. My son that he had not a card in over 10yrs. They said that according to the bank he still owed them. My son funny they have never tried to contact him on this matter. Then they ask him if he could pay and he said he got laid off and have no checks or a bank acct. THey said he could get a pre-paid visa card with $2000 and send that to them and they would take it over the phone and that would take care of it. My son thought if this is a civil case this wouldn't be that must and this would be a criminal case. And my son no and so they said they we having a sheriff come to give him the summons. When my son ask for Maxine she said that was who she was and after My son started to ask what the matter was about another person (male) got on and started talking. Maxine seem to be and African American and the male too. However race has nothing to do with this for I just want to somehow give a description of the person pulling this scram.. They made it very clear he would be summoned and arrested for avoiding the matter. This has been happening for over the past to weeks and I do have a recording on the message on my phone answering machine. They would use slurd wording on the county in which this case was filed. I just couldn't believe how much they knew. They said my son put us down for emergency and my son brothers number as well.

Another legal misquote here. These are just scare tactics. If someone files a lawsuit against you, they have to file it in the county and city where you are currently living. They cannot force you to travel to another country or jurisdiction when they decide to sue you. These are illegal debt collection practices, and it sounds like they make-up "the law" as they go along. Again, the Federal Rules of Civil Procedure do not allow anything that they are threatening to do.

someone called my husband's Aunt looking for one of our family members. she said the message sounded kinda threatening, saying if there's no response in 72 hours they were gonna send someone out to arrest him and "the next step is litigation". since there are 3 people in our family with that name I called the place to try and see if I could get any info. All they would tell me is that it was for my father-in-law and that he was "being sued by a financial institution." I think that they are some kinda collection agency but they are trying to use scare tactics to reach people. I would like to know how they are getting other family members phone numbers. If they ask you for any personal information don't give it to them cause it could also be some kind of scam
